1. Partijen

Deze overeenkomst is tussen jou ("Gebruiker") en Nossie Consultancy B.V., handelend onder de naam EquiTrail, gevestigd in Nederland ("wij", "ons").

2. De dienst

EquiTrail is een GPS-ritregistratie- en beheerapp voor ruiters, beschikbaar als mobiele app (Android/iOS) en via de website equitrail.horse. De app biedt functies zoals ritregistratie, paardenbeheer, navigatie, community en een Galaxy Watch-koppeling.

3. Account en registratie

• Je moet minimaal 16 jaar oud zijn om een account aan te maken.
• Zorg dat je accountgegevens actueel en correct zijn.
• Je bent verantwoordelijk voor de beveiliging van je inloggegevens.
• Eén account per persoon. Meerdere accounts zijn niet toegestaan.

4. Gratis gebruik en PRO-abonnement

• Gratis: Basisfuncties zijn altijd gratis, inclusief GPS-tracking, gangdetectie, paardenbeheer (max. 2 paarden), ritgeschiedenis (max. 10 ritten), navigatie en badges.
• PRO: Uitgebreide functies zijn beschikbaar via een betaald abonnement. Zie equitrail.horse/pro voor prijzen.
• PRO-abonnementen verlopen automatisch tenzij opgezegd vóór de verlengingsdatum.
• Terugbetaling: bij opzegging binnen 14 dagen na eerste aankoop heb je recht op terugbetaling.

5. Intellectueel eigendom

Alle content, software, algoritmen, logo's, namen, teksten en functionaliteit van EquiTrail zijn eigendom van Nossie Consultancy B.V. en beschermd door het auteursrecht. In het bijzonder zijn de volgende onderdelen eigendomsrechtelijk beschermd:

• De naam en het logo "EquiTrail"
• Het "Ruiterlabel"-concept
• Het paard-met-ruiter-in-gebouw-icoon (TrainingHouseIcon)
• Het gangdetectie-algoritme (stap/draf/galop via GPS-snelheidspatroon)
• Het cirkeldetectie-algoritme (heading-accumulatie)
• Het springdetectie-algoritme (GPS-hoogte, 0,4m-drempel)
• De calorieformule voor ruiter en paard per gangverdeling
• De FOMO-berichtgeneratie-logica
• De privacyafrondingsmethode voor de ruitersontdekking (~1km raster)

Het is verboden deze elementen te kopiëren, reverse-engineeren, reproduceren of commercieel te gebruiken zonder schriftelijke toestemming.

6. Gebruikersinhoud

• Jij behoudt het eigendom van je ritgegevens, foto's en andere inhoud die je uploadt.
• Door inhoud te delen, verleen je ons een beperkte, niet-exclusieve licentie om deze inhoud weer te geven aan andere gebruikers die toegang hebben.
• Je mag geen inhoud plaatsen die: illegaal is, anderen schaadt, privacyrechten schendt, haatzaaiend is of intellectuele eigendomsrechten van derden schendt.
• We behouden het recht om inhoud die deze voorwaarden schendt te verwijderen.

7. Privacy

Wij verwerken persoonsgegevens conform de AVG/GDPR. Zie ons privacybeleid voor details. Locatiegegevens worden uitsluitend gebruikt voor het leveren van de dienst en worden niet verkocht aan derden.

8. Aansprakelijkheidsbeperking

• EquiTrail is een hulpmiddel — geen vervanging voor professioneel advies of veiligheidsmaatregelen bij het rijden.
• Wij zijn niet aansprakelijk voor schade die voortvloeit uit onjuiste GPS-gegevens, storingen of gebruik van de app tijdens het rijden.
• Onze aansprakelijkheid is beperkt tot het bedrag dat je in de afgelopen 12 maanden voor de dienst hebt betaald.
• Wij zijn niet aansprakelijk voor indirecte schade, gevolgschade of gederfde inkomsten.

9. Gezondheid & Medische Disclaimer

• De calorieberekeningen, ganganalyse, sprongdetectie, stapritme en fitnesstrends in EquiTrail zijn schattingen op basis van GPS-gegevens en ingevoerd lichaamsgewicht. Ze zijn niet medisch gecertificeerd en niet geschikt voor klinische of diagnostische doeleinden.
• EquiTrail is geen medisch hulpmiddel in de zin van EU Verordening 2017/745 (MDR). De app is niet beoordeeld of goedgekeurd door enige gezondheidsautoriteit.
• Raadpleeg bij twijfel over jouw gezondheid altijd een gekwalificeerde arts of fysiotherapeut. Raadpleeg bij twijfel over de gezondheid van jouw paard altijd een dierenarts.
• EquiTrail aanvaardt geen aansprakelijkheid voor gezondheidsbeslissingen, (para)medische behandelingen of lichamelijk letsel dat (mede) gebaseerd is op gegevens uit de app — of dit nu gaat om de ruiter of het paard.
• De nauwkeurigheid van de gegevens is afhankelijk van GPS-signaal, toestelkwaliteit en correcte invoer. Meetfouten zijn inherent aan GPS-gebaseerde meting.
• De app is uitsluitend bedoeld als motivatie- en registratiehulpmiddel voor recreatief en sportief rijden.

10. Veiligheid

Gebruik je telefoon niet als dit de veiligheid in gevaar brengt. Rij nooit met je ogen op het scherm. De app is bedoeld om vóór of na de rit te gebruiken, of door een begeleider op de grond.

11. Beëindiging

We kunnen je account opschorten of beëindigen bij schending van deze voorwaarden. Je kunt je account op elk moment verwijderen via Instellingen → Account verwijderen.

12. Wijzigingen

We kunnen deze voorwaarden wijzigen. Bij materiële wijzigingen ontvang je een melding via de app of per e-mail, minimaal 30 dagen voor ingang.

13. Toepasselijk recht en geschillen

Op deze overeenkomst is Nederlands recht van toepassing. Geschillen worden bij voorkeur minnelijk opgelost. Indien dat niet lukt, is de bevoegde rechter de Rechtbank Amsterdam.

1. Parties

This agreement is between you ("User") and Nossie Consultancy B.V., trading as EquiTrail, established in the Netherlands ("we", "us").

2. The Service

EquiTrail is a GPS ride-tracking and management app for equestrians, available as a mobile app (Android/iOS) and via the website equitrail.horse. Features include ride tracking, horse management, navigation, community and Galaxy Watch integration.

3. Account & Registration

• You must be at least 16 years old to create an account.
• Keep your account information current and accurate.
• You are responsible for the security of your login credentials.
• One account per person. Multiple accounts are not permitted.

4. Free Use & PRO Subscription

• Free: Core features are always free, including GPS tracking, gait detection, horse management (max. 2 horses), ride history (max. 10 rides), navigation and badges.
• PRO: Extended features are available via a paid subscription. See equitrail.horse/pro for pricing.
• PRO subscriptions auto-renew unless cancelled before the renewal date.
• Refund: if cancelled within 14 days of the first purchase, you are entitled to a full refund.

5. Intellectual Property

All content, software, algorithms, logos, names, texts and functionality of EquiTrail are owned by Nossie Consultancy B.V. and protected by copyright. The following are specifically proprietary:

• The name and logo "EquiTrail"
• The "Ruiterlabel" concept
• The horse-with-rider-in-building icon (TrainingHouseIcon)
• The gait detection algorithm (walk/trot/canter via GPS speed pattern)
• The circle detection algorithm (heading accumulation)
• The jump detection algorithm (GPS altitude, 0.4m threshold)
• The calorie formula for rider and horse per gait distribution
• The FOMO message generation logic
• The privacy-rounding method for rider discovery (~1km grid)

Copying, reverse engineering, reproducing or commercial use of these elements without written permission is prohibited.

6. User Content

• You retain ownership of your ride data, photos and other content you upload.
• By sharing content, you grant us a limited, non-exclusive licence to display it to other users who have access.
• You may not post content that is: illegal, harmful, violates privacy, is hateful or infringes third-party intellectual property rights.
• We reserve the right to remove content that violates these terms.

7. Privacy

We process personal data in accordance with GDPR. See our privacy policy for details. Location data is used solely to deliver the service and is not sold to third parties.

8. Limitation of Liability

• EquiTrail is an aid — not a substitute for professional advice or safety measures when riding.
• We are not liable for damage resulting from inaccurate GPS data, outages or use of the app while riding.
• Our liability is limited to the amount you paid for the service in the past 12 months.
• We are not liable for indirect, consequential or lost-profit damages.

9. Health & Medical Disclaimer

• Calorie calculations, gait analysis, jump detection, stride analysis and fitness trends in EquiTrail are estimates based on GPS data and user-entered body weight. They are not medically certified and are not suitable for clinical or diagnostic purposes.
• EquiTrail is not a medical device within the meaning of EU Regulation 2017/745 (MDR). The app has not been assessed or approved by any health authority.
• For questions about your personal health, always consult a qualified doctor or physiotherapist. For questions about your horse's health, always consult a veterinarian.
• EquiTrail accepts no liability for health decisions, (para)medical treatments or physical injury to rider or horse based in whole or in part on data produced by the app.
• Data accuracy depends on GPS signal quality, device hardware and correct user input. Measurement errors are inherent to GPS-based tracking.
• The app is intended solely as a motivation and logging tool for recreational and sporting riding.

10. Safety

Do not use your phone in a way that endangers safety. Never ride with your eyes on the screen. The app is intended to be used before or after the ride, or by a ground handler.

11. Termination

We may suspend or terminate your account for violations of these terms. You may delete your account at any time via Settings → Delete account.

12. Changes

We may update these terms. For material changes, you will receive notice via the app or email at least 30 days before they take effect.

13. Governing Law & Disputes

Dutch law applies. Disputes are preferably resolved amicably. If not, the competent court is the District Court of Amsterdam.

1. Parteien

Diese Vereinbarung besteht zwischen dir ("Nutzer") und Nossie Consultancy B.V., handelnd als EquiTrail, mit Sitz in den Niederlanden.

2. Geistiges Eigentum

Alle Inhalte, Software, Algorithmen, Logos und Funktionen von EquiTrail sind Eigentum von Nossie Consultancy B.V. und urheberrechtlich geschützt. Kopieren, Reverse Engineering oder kommerzielle Nutzung ohne schriftliche Genehmigung ist verboten.

3. Gesundheit & Medizinischer Haftungsausschluss

• Kalorienberechnungen, Ganganalyse, Sprungdetektion, Schrittfrequenz und Fitnesstrends in EquiTrail sind Schätzungen auf Basis von GPS-Daten und eingegebenem Körpergewicht. Sie sind nicht medizinisch zertifiziert und nicht für klinische oder diagnostische Zwecke geeignet.
• EquiTrail ist kein Medizinprodukt im Sinne der EU-Verordnung 2017/745 (MDR). Die App wurde von keiner Gesundheitsbehörde bewertet oder genehmigt.
• Wende dich bei gesundheitlichen Fragen stets an einen Arzt oder Physiotherapeuten. Bei Fragen zur Gesundheit deines Pferdes wende dich an einen Tierarzt.
• EquiTrail übernimmt keine Haftung für Gesundheitsentscheidungen, (para)medizinische Behandlungen oder körperliche Schäden bei Reiter oder Pferd, die ganz oder teilweise auf App-Daten basieren.
• Die Datengenauigkeit hängt von GPS-Signal, Gerätehardware und korrekter Eingabe ab. Messfehler sind GPS-bedingt inhärent.

4. Geltendes Recht

Cet accord est entre vous ("Utilisateur") et Nossie Consultancy B.V., opérant sous le nom EquiTrail, établie aux Pays-Bas.

2. Propriété intellectuelle

Tous les contenus, logiciels, algorithmes, logos et fonctionnalités d'EquiTrail sont la propriété de Nossie Consultancy B.V. et protégés par le droit d'auteur. La copie, l'ingénierie inverse ou l'utilisation commerciale sans autorisation écrite est interdite.

3. Avertissement santé & médical

• Les calculs de calories, l'analyse des allures, la détection des sauts, la cadence et les tendances de forme physique dans EquiTrail sont des estimations basées sur des données GPS et le poids corporel saisi. Ils ne sont pas certifiés médicalement et ne conviennent pas à des fins cliniques ou diagnostiques.
• EquiTrail n'est pas un dispositif médical au sens du Règlement UE 2017/745 (MDR). L'app n'a pas été évaluée ni approuvée par une autorité sanitaire.
• Pour toute question concernant votre santé, consultez toujours un médecin ou un kinésithérapeute qualifié. Pour la santé de votre cheval, consultez un vétérinaire.
• EquiTrail n'accepte aucune responsabilité pour les décisions de santé, traitements (para)médicaux ou préjudices corporels subis par le cavalier ou le cheval, fondés en tout ou partie sur les données de l'app.
• La précision des données dépend de la qualité du signal GPS, du matériel et de la saisie correcte. Des erreurs de mesure sont inhérentes au suivi par GPS.

4. Droit applicable
